Terms of Service.

These Terms of Service ("Terms") govern your access to and use of the Flash7X mobile application and website at www.flash7x.app, operated by Swell Games, TOO ("we", "us", or "our"). By downloading, installing, or using Flash7X, you agree to be bound by these Terms. If you do not agree, do not use the application.

1. Description of Service

Flash7X is a premium iOS camera application that provides filmic color science, GPU-accelerated photo processing, and a curated photography experience. A paid subscription is required to access the full functionality of the application. Features accessible under a subscription include the full filmic color pipeline, portrait and night processing modes, RAW export, and unlimited photo captures.

2. Subscriptions — Apple App Store (IAP)

Flash7X Pro is an auto-renewing subscription available through two purchase channels: the Apple App Store (this Section 2) and our website at flash7x.app (Section 3). Both channels unlock the same Flash7X Pro features. This section applies only to subscriptions purchased through the Apple App Store as an in-app purchase. By initiating an App Store subscription, you agree to the following:

• — Pricing: Flash7X Pro is offered at US$4.99 per month or US$24.99 per year. Prices are displayed in the App Store at the time of purchase and may vary by region. Current pricing is listed on our Pricing page.
• — Billing period: Subscriptions are offered on a monthly or annual basis, as selected at the time of purchase.
• — Auto-renewal: Your subscription automatically renews at the end of each billing period unless you cancel at least 24 hours before the renewal date. Your Apple ID will be charged for renewal within 24 hours prior to the end of the current period.
• — How to cancel: Open the Settings app on your iPhone → tap your name → Subscriptions → Flash7X → Cancel Subscription. Cancellation takes effect at the end of the current paid period.
• — Access after cancellation: You retain full access to Flash7X Pro until the end of your paid billing period. No partial refunds are issued for unused portions of a billing period.
• — Free trial: Flash7X does not currently offer a free trial. If a trial is introduced in the future, its duration, included features, and the price charged at the end of the trial period will be clearly displayed before activation. Your Apple ID will be charged when the trial ends unless cancelled at least 24 hours beforehand.
• — Refunds (App Store): All refunds for App Store purchases are handled exclusively by Apple. Please visit reportaproblem.apple.com to request a refund.

3. Subscriptions — Web Purchases (Polar)

Subscriptions purchased on our website at flash7x.app are processed by Polar Software, Inc. ("Polar", polar.sh), our Merchant of Record. When purchasing through our website, you are entering into a transaction with Polar as the reseller of the product, not directly with Swell Games, TOO. After purchase, you activate Flash7X Pro in the iOS app using the activation link emailed to you; a web subscription unlocks the same Flash7X Pro features as an App Store subscription. By completing a web purchase, you also agree to Polar's Terms of Service.

• — Pricing: Flash7X Pro is offered at US$4.99 per month or US$24.99 per year, as selected at checkout. The price is charged at the time of purchase.
• — Auto-renewal: Your subscription automatically renews at the end of each billing period, and your payment method will be charged the same price for each renewal period, until you cancel. Charges recur automatically each billing period until the subscription is cancelled.
• — How to cancel: Cancel at any time through the Polar Customer Portal — a portal link is also included in every email Polar sends you (order confirmation, renewal notices); sign in with the email address used at purchase and Polar will send you a one-time confirmation code. You can also email us at support@flash7x.app and we will cancel the subscription for you. Cancellation takes effect at the end of the current paid billing period.
• — Access after cancellation: You retain full access to Flash7X Pro until the end of your paid billing period.
• — Refunds (web): Web purchases are covered by a 30-day money-back guarantee, subject to our Refund Policy. Refunds are processed by Polar.

4. Acceptable Use

You agree not to:

• — Reverse engineer, decompile, or disassemble any part of Flash7X.
• — Copy, distribute, or sublicense the application or its components.
• — Use the application for any unlawful purpose or in violation of any applicable law.
• — Attempt to circumvent subscription enforcement or access paid features without a valid subscription.
• — Use the application to capture content in violation of applicable privacy or recording laws.

5. Intellectual Property

All components of Flash7X — including but not limited to the application code, custom Metal shaders, proprietary color science algorithms, UI design, and branding — are the exclusive intellectual property of Swell Games, TOO. Nothing in these Terms transfers any ownership rights to you. You retain full ownership of all photographs captured using the application.

6. Disclaimer of Warranties

Flash7X is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the application will be uninterrupted, error-free, or free of harmful components.

7. Limitation of Liability

To the maximum extent permitted by applicable law, Swell Games, TOO shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, lost photographs, loss of profits, or loss of goodwill arising out of or in connection with your use of Flash7X. Our total aggregate liability to you shall not exceed the amounts paid by you for the Flash7X subscription in the twelve (12) months immediately preceding the claim.

8. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Republic of Kazakhstan, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of Astana, Kazakhstan.

9. Dispute Resolution

In the event of any dispute, you agree to first contact us at support@flash7x.app to attempt informal resolution. If the dispute cannot be resolved informally within 30 days, either party may pursue formal legal remedies in accordance with Section 8.

10. Changes to These Terms

We reserve the right to update these Terms at any time. We will notify you of material changes by updating the "Last updated" date at the top of this page and, where appropriate, via an in-app notification. Continued use of Flash7X after any changes constitutes your acceptance of the updated Terms.
